State & Federal Drug Manufacturing Laws

Under California Health and Safety Code 11379.6 every person who manufactures, compounds, converts, produces, derives, processes, or prepares any controlled substance shall be punished by imprisonment for three, five or seven years and a fine of up to $50,000.

Under federal statute 21 U.S.C. § 841, a person who knowingly or intentionally manufactures a controlled substance (including marijuana) may be charged with drug manufacturing. This is a felony that is punishable by a statutory maximum of up to 20 years in prison or as such:

Mandatory minimum of five years to forty years in prison:

  • 5 grams or more of actual meth
  • 28 grams or more of crack
  • 40 grams or more of fentanyl
  • 1 gram or more of LSD
  • 50 grams or more of a mixture containing meth
  • 10 grams or more of PCP
  • 100 grams or more of heroin
  • 500 grams or more of cocaine
  • 100 kilogram or more of marijuana (or 100 or more plants)

Mandatory minimum of ten years to life in prison:

  • 50 grams or more of actual meth
  • 280 grams or more of crack
  • 500 grams or more of a mixture containing meth
  • 400 grams or more of fentanyl
  • 1 kilogram or more of heroin
  • 100 grams or more of PCP
  • 5 kilograms or more of cocaine
  • 10 grams or more of LSD
  • 1000 kilogram or more of marijuana (or 1,000 or more plants)
